Feltételek

These terms are written to be simple and practical. They apply to use of the SimpleVideo website and service.

Section 1 — Who we are

§ 1.1 SimpleVideo is operated by Alexander Duggleby, MSc. (sole proprietorship), trading as SimpleVideo.

Section 2 — Scope

§ 2.1 These terms cover your use of the SimpleVideo website, the product app, upload workflows, video management, embedded playback surfaces, and related support channels.

§ 2.2 SimpleVideo is offered for business and organisation use.

§ 2.3 By using the service, you confirm that you are acting for a business, organisation, or professional purpose. If you are using the service as a consumer, you should not use or purchase the service without contacting us first.

Section 3 — Accounts

§ 3.1 You are responsible for keeping account access secure and for activity under your account.

§ 3.2 You must provide accurate account and billing information and keep it reasonably up to date.

Section 4 — Billing and plans

§ 4.1 Paid plans renew automatically until cancelled, unless a different billing arrangement is agreed in writing.

§ 4.2 Public pricing, plan limits, and trial details are shown on the site and in the product at the time of purchase or plan change.

§ 4.3 Plan limits are hard caps for upload, streaming, and storage. When a limit is reached, the affected service path may pause until the billing period resets or the account is upgraded.

§ 4.4 Cancellations stop future renewals. Your current paid period continues until the end of that billing cycle unless we agree otherwise in writing.

§ 4.5 Upgrades may take effect immediately. Downgrades and other plan reductions normally take effect at the end of the current billing cycle unless a different treatment is shown in the product.

§ 4.6 Trial offers may be limited by organisation eligibility, duration, and feature or usage limits. Trial terms shown in the pricing or onboarding flow form part of these terms.

Section 5 — Refund policy

§ 5.1 You may request a refund within 30 days of your last payment.

§ 5.2 Any approved refund is limited to that last payment minus incurred costs already caused by your use of the service, including third-party video, storage, delivery, transcription, summary-generation, or payment-processing costs that have already been consumed or charged.

§ 5.3 Refunds cannot exceed the amount of the last payment and may be reduced to zero where incurred costs equal or exceed that payment.

Section 6 — Acceptable use

§ 6.1 You must use SimpleVideo lawfully and fairly.

§ 6.2 You must not misuse the service, attempt unauthorized access, interfere with platform integrity, overload the service, or use the service to distribute unlawful, deceptive, or abusive content.

§ 6.3 In particular, you must not use the service to upload, host, process, or distribute:

  • content that infringes copyright, trademark, trade secret, privacy, publicity, or other third-party rights
  • malware, spyware, phishing pages, scams, spam, or other harmful or deceptive material
  • content that is illegal, obscene, defamatory, threatening, hateful, exploitative, or otherwise unlawful where it is created, hosted, or viewed
  • child sexual abuse material, non-consensual sexual content, or any exploitative sexual content
  • content that impersonates another person or organisation in a misleading or fraudulent way
  • sports, broadcast, pay-per-view, or other event content that you are not clearly authorized to publish and stream

§ 6.4 You must not use SimpleVideo as an unapproved live-streaming or short-event streaming service. If a planned use case would materially resemble live-event distribution, it requires our prior written approval.

§ 6.5 We may remove content, suspend playback, or suspend accounts immediately where we reasonably believe a use case would violate these terms, applicable law, or upstream provider requirements.

Section 7 — Your content

§ 7.1 You keep ownership of your content.

§ 7.2 You grant us the limited rights needed to host, process, deliver, transcribe, summarize, and maintain that content as part of the service.

§ 7.3 You confirm that you have the rights and permissions needed to upload, process, and publish your content through the service.

§ 7.4 We may remove or restrict content that appears unlawful, infringing, abusive, or operationally unsafe, or if we are required to do so by law, provider requirements, or a legitimate complaint.

Section 8 — Availability

§ 8.1 The service is provided on a best-effort basis.

§ 8.2 No uptime SLA is provided unless separately agreed in writing.

§ 8.3 We may perform maintenance, security work, or infrastructure changes that temporarily affect availability.

§ 8.4 Provision of the service remains at our sole discretion. Subject to mandatory law and any separately agreed written commitments, we may refuse, suspend, restrict, condition, or discontinue the service, any account, any organisation, any content, or any feature at any time where we consider this necessary or appropriate for legal, contractual, operational, security, abuse-prevention, provider-compliance, commercial, or supportability reasons.

Section 9 — Liability

§ 9.1 To the maximum extent allowed by law, SimpleVideo’s total liability is limited to the fees you paid in the 30 days before the event giving rise to the claim.

§ 9.2 Nothing in these terms excludes liability that cannot legally be excluded or limited, including liability for wilful misconduct, gross negligence, fraud, or unlawful injury to life, body, or health.

§ 9.3 We are not liable for indirect or consequential loss, including lost profits, lost revenue, lost goodwill, or lost business opportunity, to the maximum extent allowed by law.

Section 10 — Law and venue

§ 10.1 These terms are governed by Austrian law.

§ 10.2 Exclusive venue is Vienna, Austria, unless mandatory law requires otherwise.

Section 11 — Changes and termination

§ 11.1 We may update these terms from time to time by publishing a new version on this page. Material changes should take effect only after reasonable notice, unless an immediate change is required for legal, security, or abuse-prevention reasons.

§ 11.2 We may suspend access in cases of abuse, serious misuse, non-payment, security risk, provider enforcement, or material breach.

§ 11.3 Where reasonably possible, we will give you a chance to cure a remediable breach before permanent termination.

§ 11.4 After termination or cancellation, access to the service may end and hosted content may be deleted after a reasonable retention period unless we are required to keep it longer by law or for security reasons.
